This Disclosure and Agreement (Agreement) for accessing your Options Credit Union accounts via our digital banking services, is provided for your information. Please read it carefully as it pertains to your accounts and digital banking services, and it represents our mutual agreement with respect to transactions. You should print or save this disclosure statement for future reference. For the purpose of this Agreement, the terms "we," "us," "our," and "credit union" refer to Options Credit Union. "You" and "your" refers to Members and account owners who have received requested access to digital banking.
Consent - Accessing your account through digital banking services at any time confirms your agreement that you have read, understand and agree to abide by the terms and conditions of this Agreement and acknowledges your receipt and understanding of this disclosure connected with the services. You agree to be bound by future changes in terms, which will be provided electronically. You agree to be bound by future changes in terms relating to fees and consumer liability. You agree to review the disclosures that are provided each time you access the digital banking services.
By agreeing to the terms and conditions of this consent, you represent that you are authorized to enter into this consent for all persons who own or are authorized to access any of your accounts, and that such persons will be bound by the terms of this consent. You also agree to receive account statements, disclosures, and notices electronically.
We may change terms or amend this Agreement from time to time without notice or as otherwise provided by law. Electronic banking services can be used to access certain Options Credit Union accounts. Each of your accounts is also governed by the applicable disclosure statement (your Membership and Account Agreement, prior receipt of which you acknowledged).
This Agreement will be governed by and interpreted in accordance with federal law and regulation, and to the extent that there is no applicable federal law or regulation, by the laws of the State of Colorado. To the extent permitted by applicable law, you agree that any legal action regarding this Agreement shall be brought in the county in which the credit union is located. This agreement, including the validity of any signatures or consents, any claim, or disputes arising hereunder shall be construed in accordance with and governed by the Laws of the State of Colorado.
Each of your accounts at Options Credit Union is also governed by the applicable account disclosure/agreement and Truth in Savings disclosure you received when you opened your account.
Operating Systems and Security - Our digital banking services are designed to operate using World Wide Web technologies and protocols, which are adaptable to a wide range of systems. Our digital banking service uses SSL encryption and requires a browser with a current (unexpired) Domain Validation Certificate. Some older browsers may not be able to use the site without first updating the browser. Our server uses 256 bit encryption. We use cookies to help us administer the digital banking services homepage. Some browsers allow you to reject cookies from servers. If you don’t allow us to set a cookie upon entering the site, you will not be able to log in. The cookie we set contains information we need for security and allows us to time out your authority to view information.
We place the cookie with instructions that it can only be sent to a server within our digital banking domain. A cookie cannot be used to extract data from your PC. We do not store your Access Code, User Id or Password in your cookie. The cookie we set will time out your access authority to our digital banking homepage. Until it times out, you can come back to our digital banking services without logging in. After the time out period, you will need to log in again. Remember that most browsers will let you use a BACK button to view previously visited documents, even if your viewing authority has expired. For this reason, the only way to keep others from viewing your account balance is to logout of the browser when you are finished with your session. This is especially important if you are using a public or shared computer.
Account Access - To access your accounts through our digital banking services, you must have an account with our financial institution with your current information. This information is requested when you register with our digital banking systems. You may access your account(s) by mobile phone or computer using your username, password and direct connection to the Internet. By using digital banking services, you can: make inquiries, check account balances, transfer funds between accounts, make loan payments, access your statements, and more.
Services available may be added or canceled at any time. We shall update this Agreement to notify you of the existence of these new services. By using these services when they become available, you agree to be bound by the rules contained in this Agreement.
You can use digital banking services seven days a week, 24 hours a day. However, from time to time, some or all of the digital banking services may not be available due to normal system maintenance.
Transfer Terms and Limitations - In compliance with Federal Regulation D, Options Credit Union may be required to limit transfers from share savings and money market accounts to no more than six (6) transfers per calendar month, if they are to another of your accounts or a third party by means of a preauthorized, automatic, telephonic or Internet instruction.
Consumer Liability - By accessing digital banking services, you agree that it is your responsibility to safeguard your username and password, in order to prevent unauthorized transactions and/or account access. You assume all responsibility for any losses that occur on your account due to negligence i.e. failing to protect your password from unauthorized use. You also agree that Options Credit Union may revoke digital account access if unauthorized account access and/or transactions occur as the apparent result of your negligence in safeguarding the password, for any violation of the terms of use, for use of the system for illegal activities or for any other use of the system that, in the opinion of the Credit Union, presents an unreasonable risk of damage or loss to the Credit Union, its members or third parties.
Notify us AT ONCE if you believe your password has been lost or stolen, or your account has been accessed without your authorization. The best way to minimize your possible loss is to telephone, though you may advise us in person or in writing.
Statement Access -By accessing your periodic statements online, you will be able to view your account and transaction activity for your deposit and loan accounts (excluding credit card statement activity), electronic funds transfer transactions, and periodic notice of billing error rights under federal Regulations Z and E, which may contain important legal notices that affect you. In order to access your statement online, you must have active digital banking services established with the Credit Union.
Consenting to receive your statements electronically supplements and modifies other agreements that you may have with the Credit Union. To the extent that this consent and another agreement contain conflicting provisions, this consent will govern the delivery of electronic disclosures and statements, but all other contractual obligations of the parties remain subject to the terms of any other agreements. For example, you will still be required to review any account statements you receive and notify the Credit Union within established time periods if there are any errors on your statement.
Your e-mail address is required to participate in our statement delivery program. We will send you an e-mail notification at your last e-mail address of record when your online statement is available. You agree to accept responsibility for notifying us if your e-mail address changes. Your online statements will remain accessible on our web site for at least six (6) months. If we send your e-mail notification and it is returned to us as undeliverable, you will still be able to access your statement from the internet site and should do so until we can start sending you paper statements again or advise us that you are unable to access the statement. However, your participation in the program will be discontinued and subsequent statements will be distributed to you in paper form. You also agree to notify us if you are not able to receive, view or print your statement(s), at which time we may begin mailing your paper statements to the last known address on file with the credit union.
Once you enroll in this voluntary program, your paper statement will no longer be sent to you. Although you have elected electronic delivery, you do have a right to receive a paper copy of your periodic statement. To request a copy of your periodic statement please telephone us at 303-860-1117 or write to: Options Credit Union, 5935 S Zang St Unit 4 Littleton, CO 80127. The list of fees applicable to your account(s), provided elsewhere, may specify additional fees that we may charge for requests to receive an account statement in paper form.
You have the right to withdraw your consent to receive your statements in electronic form at any time. If you elect to withdraw your consent, there is currently no cost to you and your participation in the Program will be terminated. To withdraw your consent for electronic statements you must do so within digital banking services.
We reserve the right to terminate the statement service and send paper statements at any time.
Privacy - We use SSL encryption and multi factor authentication to ensure the privacy of your information when sending data between our digital banking server and your device.
The server logs multiple items of information for all members. For authorized members who use digital banking, we collect and store information such as how often members utilize features of the digital banking services, along with dates and times of various features. We use this information for internal analysis, to monitor possible fraudulent activity, and product evaluation. We never sell, transfer, or trade this information unless we are compelled by law to do so. We may gather and store information available to us on failed login attempts and other activities we consider a threat to our system. In these cases, we will share this information with other companies, agencies, and law enforcement officials as we see fit.
Passwords and Personal Information Protection - The password that is used to gain access to your information should be kept confidential, just as you would keep other security information confidential. For your protection we recommend that you change your passwords regularly. You are responsible for keeping your password, account numbers, and other account data confidential. If you believe that your password may have been lost or stolen, or that someone has transferred or may transfer money between your accounts without your permission, notify Options Credit Union at once at (303) 860-1117.
In addition to protecting your password and account information, you should also protect your personal identification information, such as your driver’s license, Social Security Number, etc. This information, alone or together with information on your account, may allow unauthorized access to your account. It is your responsibility to protect your personal information with the same level of care that you protect your account information.
Other Agreements - In addition to this Agreement, you agree to be bound by and will comply with all terms and conditions applicable to your account with Options Credit Union, as described in your Membership and Account Agreement, prior receipt of which you acknowledge.
Miscellaneous Fees and Charges - Access to most digital banking services is free. Regular charges and fees do apply on certain transactions such as requesting copies of cleared checks, ordering checks, bill payment, etc. We reserve the right to charge for certain digital banking service features such as LoanPay on Demand. You will be given at least thirty (30) days advance notice before we implement any charges or fees for any digital banking-related services.
Severability - In the event that any portion of this Agreement is held by a court to be invalid or unenforceable for any reason, the remainder of this Agreement shall not be invalid or unenforceable and will continue in full force and effect. All headings are intended for reference only and are not to be construed as part of the Agreement.
Right to Terminate Agreement - You may request termination of these services in writing. We may terminate your right to use digital banking services or to make electronic fund transfers or cancel this agreement at any time.
Our Liability - Except as specifically provided in this Agreement or where the law requires a different standard, you agree that neither we nor the service providers shall be responsible for any loss, property damage or bodily injury, whether caused by the equipment, software, Options Credit Union, OR BY internet browser providers such as Microsoft (Microsoft Explorer browser), OR by Internet access providers OR by online service providers OR by an agent or subcontractor of any of the foregoing. Nor shall we or the service providers be responsible for any direct, indirect, special, or consequential economic or other damages arising in any way out of the installation, download, use, or maintenance of the equipment, software, services, or Internet browser or access software. In this regard, although we have taken measures to provide security for communications from you to us via digital banking services and may have referred to such communication as "secured," we cannot and do not provide any warranty or guarantee.
How to Contact Us - Contact Options Credit Union in the event of an unauthorized transfer. If you believe unauthorized access occurred on your account, or that someone has transferred or may transfer money from your account by accessing your account without your permission or if for any reason you wish to contact us about your account, call or write us as follows:

Calling us is the best way to report any problems or to get questions answered. Contacting us by e-mail does not protect your rights for unauthorized access. You acknowledge and agree that the Internet is considered inherently insecure. Therefore, you agree that we have no liability to you whatsoever for any loss, claim or damages arising or in any way related to our response(s) to any e-mail or other electronic communication that we in good faith believe you have submitted to us. We have no duty to investigate the validity or to verify any e-mail or other electronic communication; and may respond to any e-mail at either the address provided with the communication, the e-mail address in your Membership Account Agreement, or any other application or written communication actually received by us. Although we have no obligation to do so, we reserve the right to require authentication of e-mails or electronic communications. The decision to require authentication is at the sole discretion of the Credit Union. We will have no obligation, liability or responsibility to you or any other person or company if we do not act upon or follow any instruction to us if a communication cannot be authenticated to our satisfaction.
